When you buy typefaces from CocijoType, you are paying for a License to use the Font Software under the terms mentioned below. The copyright on these typefaces belongs exclusively to CocijoType and/or their designer. If you do not accept this License, you may not download or use the Font Software.

General License

The General License applies to every license listed below, Desktop, Web, App / E-pub, Server, Broadcast, Social Media, for any use not covered under this document, for example a Video Game License, please contact us at info@cocijotype.com

I. Limitations on the Handling of the Font Software

1. 🔸 It is prohibited to distribute, transmit, sublease, loan, sell or generate sub-licenses, of all or part of the Font Software to any third party (including subsidiaries, franchises, affiliates, assignees, customers, agents, or service providers). By accepting this EULA, you agree to implement reasonable security and precautionary protocols to prevent the illegal use, distribution, duplication, transmission, or dissemination of the Font Software.
2. 🔸 The Font Software CAN NOT be edited in any font editing software.
3. 🔸 You may copy the Font Software for backup purposes, but you are not authorized to copy the software for any other purposes; sharing or lending the Font Software is prohibited.
4. 🔸 It is prohibited to adapt, modify, convert, translate, adjust or change the Font Software, from which the User License has been acquired, this includes producing new formats or performing reverse engineering to make adjustments.
5. 🔸 It is forbidden to alter the Font Software for the purpose of expanding or adjusting its functionality, doing so constitutes an infringement of our copyrights. Should you require a font adjustment please contact us at info@cocijotype.com
6. 🔸 Disassembling, reverse engineering or decompiling the code to access the source code of the Font Software is prohibited.

II. Changes in the terms

1. ⚠️ Since it is not possible to foresee the technological innovations that in the future could physically impact the use of the Font Software, CocijoType reserves the unilateral right to amend the terms of this License to the extent that the provisions of this document become obsolete or incomplete for new or changing technologies, effective as of the date of publication of the notice of amendment on the CocijoType website.
2. ⚠️ CocijoType is not obligated to provide updates to the Font Software for any reason. In case of offering updates, these will be subject to a new User License, which may contain different terms and rates. Accordingly, by accepting an update, this License and your rights to use the original version of the Typography Software covered by it, will automatically cease, to begin using the update and to be governed by the new License.

III. Violations and termination of license

1. ⚠️ This License is subject to termination at CocijoType's sole discretion if you violate any of the terms and conditions stated herein. CocijoType is not obliged to suggest specific conditions under which you may continue to use the Font Software after the infringement has been properly amended.
2. ⚠️ In the event of termination of the License, you must destroy the Font Software and all copies thereof, in part and in full, as well as all materials that contain the Font Software in all its forms and media and immediately submit a statement signed by an official representative of the company attesting to the destruction of the Font Software and any backup copies of it, in accordance with this License.
3. ⚠️ The amendment of an infringement or the termination of the License does not exempt CocijoType from the right to seek compensation for damages and costs derived from such infringement.
4. ⚠️ If you violate any of the prohibitions of this License, in addition to the costs of any damage that the violation may cause, CocijoType will have the right to demand payment for the cost of investigating and addressing the violation to enforce the License and/or terminate the agreement, including reasonable attorney and investigator fees.
5. ⚠️ The license WILL BE TERMINATED when the software is used to represent criminal associations such as mafias, drug cartels, terrorist associations, armies (including those belonging to the government of a country), armed forces or guerrillas, leaving CocijoType without any legal responsibility derived from this use.

IV. Disclaimer and limited warranty

1. ⚠️ CocijoType is not liable to you or to any other person or entity for any direct, indirect, consequential, incidental or punitive damages (including damages for loss of business profits, business interruption, loss of business information and the like) arising from the use or inability to use the Font software.
2. ⚠️ Without limiting the generality of the foregoing disclaimer, CocijoType does not warrant that the Font Software will operate uninterruptedly without error.
3. ⚠️ The Font Software that CocijoType provides as a retail typeface is not made to work in navigation systems, medical equipment or technology where human life or other forms of life may depend on the software, for this reason CocijoType is not responsible for any direct or indirect damage in relation to loss of lives or accidents.
4. ⚠️ If during shipment or upon receipt of the Font Software, it is damaged or delayed, CocijoType will replace the Font Software with another of the same version, styles and corresponding variables.
   CocijoType does not issue refunds or returns.
5. ⚠️ If the Font Software that we provide presents any failure or error, please contact info@cocijotype.com specifying the details of the problem and we will try to resolve it or resend the files to you as long as it is a failure corresponding to the Font Software that we offer and that has nothing to do with the lack of support for the software or system in which you use it.

V. Copyright

1. 🔸 CocijoType warrants that it is the creator, official distributor and sole owner of the intellectual property and other rights corresponding to the Font Software. All rights not expressly granted to you in this License are reserved for CocijoType.
2. 🔸 The font and accompanying materials are protected by copyright and contain proprietary information and trade secrets belonging to CocijoType. Unauthorized copying of the Font Software is expressly prohibited. You may be held legally liable for any infringement of CocijoType's intellectual property rights that is caused or promoted by your breach of the terms of this Agreement.

VI. General

1. 🔸 In order to ensure adherence to the limitations presented in this License, CocijoType reminds you that said License is not transferable and that any transfer of it will be null and void from the beginning. This means that you cannot assign your rights or obligations arising from this License, in part or in whole, to any other person or entity without the permission of consent in writing granted by CocijoType.
2. 🔸 No waiver of this License or any right or remedy cited herein shall be effective unless there is a written communication signed by CocijoType.
3. 🔸 The License to use CocijoType retail fonts is not exclusive.
4. 🔸 The Font Software and accompanying written materials are provided "as is". CocijoType makes no warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and/or fitness for a particular purpose.
5. 🔸 This Contract is governed by Mexican law. You agree that the courts of Mexico will have exclusive jurisdiction to settle any dispute or claim, however, we can take proceedings against you in any other court of competent jurisdiction.
6. 🔸 This License, modified by any addendum issued by CocijoType, constitutes the sole and total link between the parties with respect to the Font Software, replacing all previous or current proposals, communications and understandings, oral or written.

Desktop License

The Desktop Use License is necessary when the font will be installed on your local computer or computers, with this license you can make printed products, you can attach the font in print and preview mode, but you can't generate a document with editable embedding.

The Font Software licensed under this License may not be used for purposes other than those specified in the License.

The cost of the License is calculated by the number of computers on which the Font Software will be installed.

Installation

Through this EULA, CocijoType grants non-transferable, limited and non-exclusive permission to install the Font Software only on the maximum number of computers or other electronic devices specified in the indicated purchase confirmation order (CONFIRMATION). As well as permission to use, reproduce and display the Font Software identified in the Confirmation for the reproduction of texts.
Any device included within the maximum number allowed in the confirmation order has the right to access and operate theFont Software for DESKTOP USE.

Permitted Uses of Desktop Licensed Typography Software

1. Software can be used to generate graphic pieces or text.
2. This License allows the creation of images for paper, photographs, printed material and other surfaces where the image is of a fixed size. The Font Software must be used to generate NON-EMBEDDED FILES, that is, converted to curves or rasterized as a bitmap (see section d), except in the case of editorial publications such as books or magazines, where non-editable pdf files can be generated.
3. The use of this license allows users to generate graphic pieces for social media networks like Instagram, Facebook, Twitter, Tik tok, Pinterest and others with up to 9999 followers. If you need to use the font for social networks with 10,000 followers or more, you need to acquire the Social Media License.
4. You are allowed to convert characters from the Font Software to graphic objects in a vector drawing program and modify those graphic objects. In that sense, the Font Software can be used to generate pieces of logos and lettering.

Limitations on Uses of the Desktop License

The Font Software can NOT be used to generate ornamental and decorative objects (where the typography is the main element), for retail or wholesale sale (T-shirts, stickers, cushions, chocolates, house numbers, alphabet soup, etc). If you need the Font Software for these purposes please contact info@cocijotype.com

Non-Embedded Files Creation Permission

This License allows the creation of NON-EMBEDDED FILES (files or formats where the letterforms are rasterized or converted into curves or vectors). You CAN NOT embed the Font Software on your website or web page under the Desktop License. If you need to use the Font Software on a website you need to acquire the Web use License.
Embedding the Font Software into another software, a website or any other application under a Desktop License is strictly prohibited.
The Desktop Licensed Font Software cannot be used on the Web whether rasterized or not. Such use requires a Web License which can be acquired from the CocijoType website. For any use on the web, social networks, apps, servers or television, the corresponding License is required.
You may only provide your design product using the Font Software to UNLICENSED THIRD PARTIES (including your customer) in a non-embedded file or format (for example, .JPG, .PNG, GIF or TIFF, or a raster vector format (for example, a .PDF file or .EPS created using the Create Outlines tool of Indesign or Illustrator) or a secure format (for example, a protected .PDF file that does not allow extraction of the font)

Prohibition of redistribution of the Font Software for Desktop License

1. 🔸 If you need to send to your client a file that he can edit or modify using the Font Software, your client will need to buy his own License to use the Font Software provided by CocijoType
2. 🔸 If you need to send files to external 2D printing providers you must provide non-editable PDF files. In case you need to share editable files you must make sure that your provider acquires its own License of the Font Software.
3. 🔸 If you are a natural or legal person that hires a design studio or freelance designer to create a project for you, you are not allowed to share the Font Software, except for non-embedded files. If your design provider needs to make adjustments or changes to your project, using the Font Software, it will need to acquire its own User License. If your design provider has acquired the user license to make your designs, you must acquire your own License to use the Font Software, according to the channels where you are going to use it.

Web use License

This license is required to display the text of the selected Font Software on a website.
The Font Software licensed under this License may not be used for purposes other than those specified in the License.
The cost of the License is calculated by the number of monthly visitors. If you exceed the number of monthly visits for which you have paid the Web License, you must upgrade your License.
CocijoType reserves the right to request an accurate report of your page view counts, and you hereby agree to provide it reasonable promptly.
Through this EULA, CocijoType grants non-transferable, limited and non-exclusive permission to use the Font Software in the specified website with the number of monthly visits in the indicated purchase confirmation order (CONFIRMATION). Permission to use the font is granted by means of the CSS code called @ font-face.
Fonts are provided in WOFF and WOFF2 format for self-hosting.
You must purchase a Web License for each unique domain in which you require to use the Font Software. There is no limit to the number of subdomains in which you can use the Font Software.
This license is subject to the number of monthly views allowed in your Confirmation Order. If you require a greater number of views please contact info@cocijotype.com to update your package.

App and electronic publication License

This License is required for electronic publications such as e-books, applications for mobile phones or tablets, and software applications that require embedding of the Font Software.
The Font Software licensed under this License may not be used for purposes other than those specified in the License.
The cost of the App and E-pub License is calculated with the number of application downloads.
The Licensee must provide the name of the App or E-pub where the Font Software will be used.

⚠️ This License does not permit embeding the font software in such a way that the font's outlines may be extracted or edited.

Internal Server License

The company server license allows the installation of the Font Software on a server for use in a company located in a specific geographic area.
The Font Software licensed under this License may not be used for purposes other than those specified in the License.
The cost of the License is calculated with the number of people who will use the server.
When purchasing a Company Server License, the fonts are provided in OpenType TTF format for installation on the company servers. This means that company employees can have access to the fonts without having to install the font files on their local or personal computers.
The Company Server License is granted per office and for one geographic location only. Fonts CAN NOT be shared between servers in various offices in cities or countries.

Broadcast License

The Broadcast License is necessary to use the Font Software in films, cinema, television, live broadcasts on YouTube, Facebook, Vimeo, Netflix, Prime Video or any other streaming platform.
The Font Software licensed under this License may not be used for purposes other than those specified in the License.
The cost of the License is calculated with the number of productions in which the font will be used, regardless of the number of channels where it will be displayed, that is, a Broadcast License can be used in the credits and advertising of a production regardless if it’s used on YouTube, Netflix, Vimeo, Amazon Prime or any other streaming service.
This License allows you to use the Font Software on movie credits, subtitles, movie ads, TV or online ads.
The fonts are provided in TTF to be incorporated into an audiovisual product. It is your responsibility to ensure that the fonts fit and embed correctly in the medium you will be using.
The purchaser of the License must provide the name of the production where the Font Software will be used.
